Do I have the right to raise a Section 75 claim through my credit card issuer?
Yes, you have the right to raise a Section 75 claim through your credit card issuer if you book a flight or holiday with Friends and Family Travel and the company goes bust. Section 75 of the Consumer Credit Act 1974 makes the credit card issuer jointly and severally liable with the retailer for any breach of contract or misrepresentation.
This means that if Friends and Family Travel goes bust, you can claim a refund from your credit card issuer, even if the travel company was unable to provide you with the goods or services that you paid for.
